These terms govern your use of Diemeco (the "Platform"), operated by Diemeco, Dudh Sagar Road, Rajkot, Gujarat, India, 360003 ("we", "us"). By creating an account or using the Platform you agree to them. If you do not agree, do not use the Platform.
1. What Diemeco is
Diemeco is an online marketplace that helps people who need parts or jobs made ("Clients") find manufacturing workshops and professionals ("Workshops") whose machines and materials fit. We introduce the two sides and provide messaging, quotation and file-sharing tools. We are an intermediary. We are not a party to any contract between a Client and a Workshop, we do not manufacture, inspect, transport or guarantee any work, and we do not guarantee that any requirement will receive a quotation or any Workshop will find work.
2. Accounts
- You must be at least 18 and able to enter a binding contract in India, or act for a business that is.
- You sign in with a mobile number verified by a one-time code. You are responsible for everything done through your account and for keeping your phone secure.
- What you tell us (name, workshop details, machines, GSTIN, email) must be true and kept up to date. We may verify it, and may remove badges or suspend accounts that are inaccurate.
- One person may hold both a Client and a Workshop profile, but must not use one to deal with the other for the purpose of gaming reviews, credits or matching.
3. Clients
- You may post requirements describing what you need made. You are responsible for the accuracy of the description, drawings and files, and for having the right to share them.
- You choose per file whether Workshops may only view it (a watermarked view) or may also download it. Files shared as view-only are shown as watermarked images; that protects your designs but cannot physically prevent someone photographing a screen, so do not share what you cannot afford to have seen.
- Posting is free. You decide which Workshops you accept and whom you assign a job to.
4. Workshops, credits and payments
- Workshops use credits to unlock a Client's requirement details. Credits are bought in plans (for example Weekly, Monthly, Yearly). Each plan lists its price, number of credits and validity period; prices are inclusive of GST where GST applies.
- Credits and plans are valid only for the period stated and expire afterwards. Buying a plan while another is valid extends the validity.
- Payments are processed by Razorpay. We do not see or store your card, UPI or bank details.
- We issue an invoice or receipt for each purchase. You must confirm your email address before buying.
- Credits are refunded to your balance in the cases described in our Refund Policy. Credits have no cash value and cannot be transferred.
- Quotations you send are your own offers. Any agreement, price, delivery, quality, payment and warranty terms are solely between you and the Client.
5. What you must not do
- Post anything false, misleading, unlawful, infringing, or that involves items or processes prohibited by Indian law (including weapons, and anything you have no right to have made).
- Copy, scrape or resell Platform data, or try to bypass credits, view-only protection, watermarks, rate limits or any other safeguard.
- Harass or abuse others, post fake reviews, or manipulate reviews or ratings, including through self-dealing between your own accounts.
- Use the Platform to take business off it after a Workshop has used credits to reach a Client, in a way intended to defraud the other party.
- Interfere with the Platform, probe or attack its security, or use another person's account.
You can report a requirement, message or profile from within the Platform. We may remove content and suspend or close accounts that break these terms, with or without notice where we think it necessary, and will refund unused paid credits where the Refund Policy says so.
6. Your content and our licence
You keep ownership of everything you upload or write, including designs and drawings. You give us a limited licence to store, process, display (including as watermarked images) and transmit it as needed to run the Platform for you and the people you choose to share it with. Workshops receive no rights in a Client's designs by viewing or downloading them, and must use them only to prepare a quotation or to do the job awarded to them. Files are deleted after a requirement is removed, subject to a short technical delay and any legal retention requirement.
7. Messages and reviews
Messages between users are stored so both sides can continue the conversation, and may be reviewed by us to investigate a report or misuse. Reviews must be honest and about a real job. We may remove reviews that break these terms.
8. Availability and changes
We work to keep the Platform available but do not promise it will always be uninterrupted or error-free. We may change or discontinue features. We may update these terms; if a change is significant we will tell you in the Platform, and continued use after the change means you accept it.
9. Disclaimers and limits on our liability
The Platform is provided "as is". To the fullest extent the law allows, we are not liable for the quality, safety, legality, timing or payment of any work arranged through the Platform, for what other users say or do, or for indirect or consequential losses or lost profits. Our total liability to you for any claim relating to the Platform is limited to the amount you paid us in the 12 months before the claim arose. Nothing here limits liability that cannot be limited by law.
10. Ending your account
You may stop using the Platform at any time and ask us to delete your account (see the Privacy Policy). We may suspend or end accounts as set out above.
11. Governing law and disputes
These terms are governed by the laws of India. The courts at Rajkot have exclusive jurisdiction, subject to any non-waivable rights you have as a consumer. Please write to us first at support@diemeco.com so we can try to resolve the problem informally.
12. Other agreements and policies
These terms are read together with the following, which form part of them: the Workshop Agreement (for Workshops), the Client Agreement (for Clients), the Privacy Policy, the Refund & Credit Policy, the Content & Upload Policy, the Confidentiality & Intellectual Property Policy, the Dispute policy and the Grievance Policy. If there is a conflict, the more specific document for your role prevails on the subject it covers.
